Draft terms — final business and legal review required
These terms describe intended commercial practice. They have not been reviewed by a qualified legal adviser, the governing law has not been set, and several provisions contain editable placeholders. 1. Use of this website
By accessing or using this website you agree to these terms. If you do not accept them, please do not use the site. We may restrict or withdraw access to the website, or to parts of it, without notice where necessary to protect the site, our customers or our business.
You must be at least eighteen years old and legally able to enter into a binding contract in order to place an order.
2. Accounts
You may place an order with or without creating an account. Where an account is created, you are responsible for keeping your login details confidential and for activity carried out under your account. Tell us promptly if you believe your account has been used without your authorisation. We may suspend or close an account where these terms have been breached.
3. Product information
We publish the specifications we hold for each product. Containers are manufactured to standard external dimensions, but internal dimensions, coatings, fittings, door hardware and cosmetic condition vary between manufacturers, production years and individual units.
Where a specification is not confirmed for a particular unit, the product page indicates that the specification should be checked rather than presenting an estimated figure. Photographs are representative of the product type and may not depict the exact unit supplied. If an exact dimension or feature is critical, contact us before ordering so it can be confirmed for the specific unit.
4. Availability
All products are offered subject to availability. Stock levels change as orders are placed, and in rare cases a product may become unavailable after an order is submitted. Where this happens we will contact you to offer an alternative unit or a full refund. We do not charge for a product we cannot supply.
5. Pricing
Prices are shown on each product page in the currency indicated at checkout. Prices may change at any time before an order is placed. The price applicable to your order is the price displayed at the time the order is submitted.
We take care to price accurately. If an obvious pricing error occurs, we reserve the right to cancel the affected order and refund any amount paid rather than supply at a price that was plainly incorrect.
6. Orders and acceptance
Submitting an order is an offer to purchase. The order confirmation we send acknowledges receipt of that offer; it does not by itself form a contract. A contract is formed when we confirm that the order has been accepted and the goods have been allocated for preparation and dispatch.
We may decline an order where the product is unavailable, where a pricing or description error has occurred, where delivery to the address is not practicable, or where we suspect fraudulent use of a payment method.
7. Payment
Payment is taken through the payment methods made available at checkout. Card details are handled by the payment provider and are not received or stored by Container Flex Depot. 8. Taxes and duties
Applicable taxes are calculated and displayed at checkout based on the delivery address. Where an order is subject to additional local charges, those charges are the responsibility of the customer unless stated otherwise at the point of sale. [EDITABLE TAX TREATMENT]
9. Shipping and delivery
One delivery option is offered on every product:
- Delivery — $450. Estimated delivery 5 business days after dispatch.
Delivery estimates are estimates and not guarantees. Orders are typically processed within one business day before dispatch preparation begins. Delivery requires suitable site access; the customer is responsible for confirming that the placement point is reachable, that the ground is firm and level, and that overhead clearance is adequate. Full details are set out in the shipping and delivery policy, which forms part of these terms.
Where a delivery cannot be completed because the site was not ready or access was not as described, additional charges for a repeat attempt may apply.
10. Risk and title
Risk in the goods passes to the customer on delivery. Title passes when payment has been received in full. Until title passes, the goods must not be sold, modified structurally or encumbered.
11. Delivery inspection
You should inspect the container at the point of delivery. If there is visible transit damage, photograph it before the carrier leaves, note the damage on the delivery documentation, and notify us promptly. Preserving this evidence is what allows a transit damage claim to proceed. The shipping policy sets out the process in full.
12. Returns, cancellations and refunds
The returns and refunds policy forms part of these terms and sets out the return window, cancellation position, return authorisation process, return transport responsibility, restocking treatment and refund timing, together with the categories of product that are excluded. Modified, custom and special-order units are treated differently from standard stock.
13. Warranty
Warranty coverage follows the individual product and any applicable manufacturer coverage. We do not apply a single blanket warranty period across the catalogue. The warranty centre explains what is covered, what is excluded, the maintenance responsibilities that apply, and the evidence needed to open a claim.
Nothing in these terms is intended to exclude or limit any statutory rights that cannot lawfully be excluded.
14. Intellectual property
The content of this website, including text, layout, graphics, icons, photography and software, is owned by or licensed to Container Flex Depot and is protected by intellectual property law. You may view and print pages for your own use in evaluating or placing an order. You may not reproduce, republish or exploit the content commercially without written permission.
15. User content
Where the website allows you to submit content such as reviews, photographs or enquiry attachments, you confirm that you own the content or have the right to submit it, and you grant us a non-exclusive licence to use it in connection with the operation and promotion of the website. We may decline to publish, or remove, content that is unlawful, misleading, offensive or unrelated to the product concerned.
16. Prohibited use
- Using the website for any unlawful purpose.
- Attempting to gain unauthorised access to any part of the site or its infrastructure.
- Introducing malicious code or interfering with the operation of the site.
- Extracting content systematically for republication or to build a competing catalogue.
- Placing fraudulent or speculative orders.
17. Limitation of liability
We accept liability for death or personal injury caused by our negligence, for fraud, and for any other liability that cannot lawfully be excluded. Subject to that, and to the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of business, loss of contracts, loss of anticipated savings, or losses arising from site conditions, placement decisions or the use to which a container is put after delivery.

18. Indemnity
You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these terms, your misuse of the website, or your use of a product in a manner contrary to the product specification, applicable regulation or reasonable safety practice.
19. Events beyond our control
We are not liable for failure or delay in performing our obligations where that failure or delay results from events beyond our reasonable control, including severe weather, industrial action, carrier failure, supply interruption, civil disruption or actions of public authorities. Where such an event occurs we will contact you and, where appropriate, agree a revised delivery date or cancel the order and refund in full.
20. Disputes
If something has gone wrong, contact us first. Most issues are resolved directly and quickly. If a matter cannot be resolved informally, the parties will engage in good faith discussion before commencing formal proceedings. 21. Governing law
